1. Scope and enrolment

These terms apply only to a feature or environment expressly labelled pilot, beta, preview, experimental, or early access and enabled under an approved agreement and feature gate. They supplement the Terms of Service, Privacy Notice, Data Processing Agreement, and applicable order.

General registration, a waitlist submission, or access to a normal production feature does not by itself enrol a customer in an early-access programme.

Bibeno's current restricted beta is invitation-only and non-paying. No payment method is required for beta access, no subscription fee is charged during that restricted beta, and participation does not automatically convert to a paid plan. Any later paid service requires a separate informed order or checkout acceptance showing the price, billing cycle, taxes, cancellation terms, and payment authorisation before a charge can occur.
Non-paying describes the fee charged by Bibeno for beta access. It does not authorise the customer to take live consumer orders, collect customer payments, send direct marketing, use high-risk workforce or finance features, or process unapproved special personal information. Each such workflow remains blocked until its own feature gate, notices, agreements, safeguards, and evidence are approved for the named business and branch.

2. Authorized purpose and users

The customer may use the early-access service only for the agreed evaluation or restricted operational purpose, territories, branches, users, data classes, and period. Access may not be transferred, resold, benchmarked publicly, or expanded to a high-risk use without written approval.

3. Pre-release nature

The service may be incomplete, change materially, contain defects, have limited support, or be withdrawn. Documentation, interfaces, calculations, exports, integrations, and data models may change before general availability. The customer must not rely on an early-access service as its only record or business-continuity mechanism.

4. Availability and support

No uptime, response, recovery, compatibility, or general-availability date is promised unless the approved pilot order expressly states it. Bibeno will provide the support, maintenance, notice, and incident treatment stated in that order and the Support Policy.

5. Customer safeguards

  • Use representative or minimized data where the evaluation does not require live personal or financial data.
  • Maintain independent source records, exports, reconciliation, and a documented fallback for every material operation.
  • Restrict access to trained authorized users and report defects, security concerns, and material data discrepancies promptly.
  • Do not use a beta output as final legal, tax, payroll, employment, payment, health, safety, or regulatory advice.

6. Personal information and customer data

The Privacy Notice and Data Processing Agreement apply fully to early-access processing. A beta label does not reduce Bibeno's POPIA, confidentiality, security, incident, rights-request, retention, or deletion obligations. The approved pilot must identify any new purpose, data category, provider, region, or automated processing before use.

7. Security and incidents

The Security Measures Schedule applies. Bibeno may suspend an early-access feature immediately where continued use creates a material security, privacy, financial-integrity, or legal risk, while preserving reasonable export, evidence, and safe-exit paths.

8. Feedback and usage information

The customer may provide feedback voluntarily. Bibeno may use non-confidential feedback to improve the service without transferring ownership of the customer's data, branding, or pre-existing intellectual property. Product telemetry is processed only for disclosed, approved purposes and subject to the Privacy Notice and DPA.

9. Confidentiality and publicity

Non-public product information, unreleased functionality, security information, and pilot results are confidential where identified or reasonably understood as confidential. Neither party may use the other's name, logo, testimonial, or pilot participation publicly without authority.

10. Fees and commercial status

Any fee, credit, free period, usage limit, tax treatment, renewal, and conversion to a paid production service must be stated clearly in the approved order. Participation does not create an automatic paid renewal or production commitment unless the customer makes the required informed choice.

11. Changes and withdrawal

Bibeno may change or withdraw an early-access feature on reasonable notice where practicable, or immediately for material risk. The customer may stop using the feature at any time, subject to any expressly agreed pilot wind-down. A material contractual change is versioned and presented for acceptance where required.

12. Exit, export, and deletion

The pilot agreement must identify the available export, migration, reconciliation, return, deletion, and retention process. Bibeno will not intentionally trap customer data in an unsupported beta format. Legal holds, security evidence, backups, and mandatory records remain governed by the DPA and retention schedule.

13. Production migration

General availability, production activation, or migration requires the applicable production feature gates, approved legal documents, current customer acceptance, readiness evidence, and any commercial order. Pilot acceptance does not substitute for a production acceptance that is materially different.

14. Risk allocation and mandatory rights

The Terms of Service govern liability subject to the pilot's disclosed limitations. Nothing in these terms excludes liability or a remedy that cannot lawfully be excluded, and no beta disclaimer excuses fraud, gross negligence, unlawful processing, or failure to use promised safeguards.

For Bibeno's current free restricted beta, each party's aggregate liability that may lawfully be capped is limited to R1,000 unless the signed pilot order states a higher amount. The exclusions from the liability cap in the Terms of Service still apply, and this amount does not replace any mandatory consumer, privacy, security, payment, or other remedy.
